Terms & Conditions

1. Scope

These Terms and Conditions ("T&C") apply to all contracts and services between CREATIVES ATTRAACT OG ("Agency"), based in Vienna, and its clients ("Clients"). Deviating arrangements require written form and explicit approval by the Agency.

 

2. Offers and Contract Formation

Offers provided by the Agency are non-binding unless explicitly marked as binding. Contracts become valid upon written confirmation or signing of an offer.

 

3. Scope of Services and Obligations

The Agency commits to providing agreed services with utmost care and according to the agreed scope. The Client agrees to timely provide the Agency with all necessary information and documents required for the project's completion.

 

4. Usage Rights

All rights to ideas, concepts, designs, graphics, photos, and videos remain the property of the Agency unless otherwise agreed. Clients are granted only the agreed usage rights.

 

5. Social Media Management – Special Conditions

For Social Media Management provided by the Agency, the following conditions apply to the usage rights for photos, videos, and other created content unless explicitly agreed otherwise:

  • All content (photos, videos, graphics) created by the Agency may only be used during the active period of Social Media management.

  • After the termination of Social Media management, previously published content may remain on social media platforms but must not be reposted or reused for new purposes unless explicitly agreed in writing.

  • Any additional usage requires a separate written agreement and potentially additional compensation.

 

6. Compensation and Payment Terms 

Compensation is based on individually agreed fees. Agency invoices are due without deductions within 14 days from the invoice date. All prices are exclusive of applicable statutory VAT & net prices.

 

7. Liability

The Agency is liable only for damages caused by intent or gross negligence. Any further liability is excluded. The Agency does not assume liability for content published upon the client's request or specification.

 

8. Confidentiality

The Agency agrees to treat all provided information and documents confidentially and not disclose them to third parties.

 

9. Final Provisions

If any provision of these T&C becomes invalid, it does not affect the validity of the remaining provisions. These T&C are governed exclusively by Austrian law. Jurisdiction, if legally permissible, is Vienna, Austria.
